Violet Anne Wynne, the partner of Clare independent TD Violet Anne Wynne, pleaded guilty to illegal possession of cannabis on February 11th last year at the family home in Pella Road, Kilrush.
John Montaine (40) had already lost most of his teeth due to severe epileptic episodes, according to the court. Mr Montaine has been seizure-free for the past six years, according to his lawyer, after using THC oil, a cannabis derivative.
After Mr Montaine pleaded guilty to illegal possession of cannabis at the family home on Pella Rd in Kilrush on February 11th, Judge Mary Larkin imposed a punishment of €100 at Kilrush District Court.
After Mr Montaine’s third conviction for driving without insurance, Judge Larkin imposed his third driving restriction.
Mr Montaine has 16 prior convictions, according to Sgt Louis Moloney, including two for driving without insurance in June 2014, when he was prohibited from driving for two years, and one in 2012, when he was suspended for one year.
On February 8th, 2021, Judge Larkin ordered a two-year ban on Mr Montaine for driving without insurance in a 192 registered black Ford Grand C-Max at Decomede, Lissycasey, Co Clare.
Mr Montaine pays €500 a month for his insurance policy, and he believed he was covered on the date, according to defence lawyer Patrick Moylan.
Mr Montaine “has misread the law in relation to insurance,” according to Mr Moylan.
“He had no cover since he had a provisional license, and if he has a provisional license, he must be accompanied,” Judge Larkin remarked.
